Sergeant Smith, Constable to No. 3 Stockade testified...The prisoner s sentence in irons expired on the 21st of July 1835. He stated himself to be a free man in consequence he was discharged under false pretences. He was ordered by Lieut. Gibson to remain at Newcastle until such time as we got some information concerning his freedom. He left Newcastle without a pass. I have not seen him since until he was forwarded from Sydney this morning. Guilty. Sentenced to 12 months to an iron gang
